I have been covering per diem appearances in Queens County since 2001. In all these years I have found that Queens is a little quirky. Queens County has its own twists and turns. I do my best to keep up to date on what goes on there. I am in Queens everyday and can provide reliable, professional coverage for your firm. The tabs above have information regarding the Part requirements and judges’ contact information.

I am now offering Trial Counsel services. Cases will be tried by Patrick Mantione, Esq. Pat has over 25 years of trial experience, all at Corporation Counsel. . During his time there, Pat tried every type of case imaginable. The range of cases include trip & falls, premises liability, auto case and municipal liability, among others. The level of injuries involved in those cases include everything from soft tissue back cases to brain damaged infants. His preference is to try cases in Nassau, Suffolk & Queens, but is available to try cases in all jurisdictions. Unfortunately he cannot be involved with cases in which the City of New York is a defendant until Sept. 2023. His resume is available upon request.

Important Updates

July 25, 2023

The Court has created a new Part – the Non-Compliance Part. Conferences will be held in person as of Monday, August 14, 2023 in Rm. 314. There will be a calendar call at 9:30am, 11am and 2:15pm. This will be three separate calendars. See the attached memo issue by the Court.

The cases that will be on this calendar will have already had a compliance conference Order issued by the Court, or submitted by the parties, dated Feb. 7, 2022 or earlier – and there is discovery outstanding. Parties will be notified of this appearance through eCourts. Part Rules have also been issued.

June 7, 2023

Beginning Monday, July 10th J. Catapano Fox will have an in person motion calendar call. The call will begin at 10am and there is only one call. Discovery motion are expected to be worked out. All other motions will be on submission. Please see her Part rules part06.pdf (nycourts.gov).

Additionally, she has been the Compliance Conference Judge for all the City cases since February 2023.

April 28, 2023

A recently posted memo on the NYCOURTS website finally gives attorneys an avenue to request an adjournment of a set trial date. This in no way guarantees that you will get the adjournment.

Parties can email the Court at QSCTrials@nycourts.gov to request an adjournment or a settlement conference for cases have a set trial date and do not yet have a trial judge assigned.

In-Person Appearances on Discovery Motions
(Amended)

Effective March27,2023, in-person appearance will be required on discovery motions, only, filed before Justice Anna Culley [Part 27], Justice Phillip Hom [Part 14], Justice Denise N. Johnson [Part 11], Justice Mojgan C. Lancman [Part 20], Justice Leonard Livote [Part 33], and Justice Frederick D. R. Sampson [Part 31]. Please note that discovery motions filed before Justice Phillip Hom andJustice Denise N.Johnson will require an appearance at the Long Island City courthouse located at 25-10 Court Square, Long Island City, New York.

Effective April17,2023, in-person appearances will be requiredon discovery motions, only, filed before Justice Carmen R. Velasquez [Part 38]. Discovery motions include motions made pursuant to Article 31 of the CPLR,22 NYCRR §202.7 and 22 NYCRR §202.8. Motions for summary judgment are not included in this category.

A copy of the NYSCEF Confirmation Notice(s) for any document(s) e-filed by a party under the sequence number of the discovery motion must be submitted by that party to the Part Clerk on the return date, or any adjourn date, of the discovery motion.

The Part rules for the above Justices should be reviewed prior to filing a discovery- related motion. The Justices’ individual Part rules can be foundon the Queens Supreme Court, Civil Term web page under the “Judges Part Rules” link.
